GENERAL TERMS AND CONDITIONS OF SALE



Although we have drafted our general terms and conditions of sale based on common sense, they are tailored to our operations and what we believe to be your legitimate expectations, and they are unlike any others. We believe it is important that you understand them fully, in particular so that you are aware of how we work, our obligations, and also your obligations, as you will have some if you choose to work with us. Please read them and see if they are acceptable to you.



SCOPE OF APPLICATION AND SERVICE PROVIDER


With the exception of the paragraph entitled “WE WORK WITH RESPONSIBLE MEN AND WOMEN”, these general terms and conditions of sale apply to sales contracts concluded online via the website www.vat-free-silver-coins.fr or by email exchange with customercare@vat-free-silver-coins.fr between SARL Globalsilver (“we” or “Globalsilver”), located at 10 rue Joseph Audic, 56000 Vannes, France, SIRET 53394164700026, and its consumer customers (you). The paragraph entitled “WE WORK WITH RESPONSIBLE MEN AND WOMEN” is a contract between Eric Peiffer, a man, at times acting as manager of SARL Globalsilver, and you, a man/woman. The validation of a purchase offer therefore binds you in two ways: as a legal person whose liability is legally limited, and as a man or woman whose liability is contractually unlimited in the event that you fail to comply with the contract set out in the paragraph entitled ‘WE WORK WITH RESPONSIBLE MEN AND WOMEN’.


Our offer is intended for adults. By purchasing our products, you agree that you have reached the minimum legal age required.



WE SPEAK SEVERAL LANGUAGES

However, we prefer written communication and believe that in most cases you will receive a quicker response by contacting us in writing.


We respond to emails in French or English, which we speak fluently. You are free to contact us in writing in another language, but we will have your email translated by deepl.com before responding in French or English. We suggest you use deepl.com to translate our correspondence into your language. Any email we send you is binding if we have written it in French or English.



WE ONLY SELL TO PRIVATE CUSTOMERS


If you confirm a purchase offer on behalf of a company, your purchase offer will, at our sole discretion, either be refused or treated as a purchase offer made by a private customer, which means that your invoice will not mention the VAT number of that company. In such a case, you waive any right of recourse, you are responsible for ensuring that your accounts are in order, and you will not be entitled to any penalty or compensation of any kind.



WE RECOMMEND THAT YOU ADD OUR EMAIL ADDRESS TO THE LIST OF AUTHORISED SENDERS


We believe it is important that you ensure you receive our emails by adding the address customercare@vat-free-silver-coins.fr to your list of authorised senders. If you do not do so, you may not receive our emails regarding the shipment of your order, the contractual deadlines may be exceeded, and we may have to charge you penalties, which we would prefer not to do.

It is your responsibility to check your emails, including your spam folder, to ensure that you do not miss any of our emails.



WE WORK WITH RESPONSIBLE MEN AND WOMEN


This part of our terms and conditions of sale is a contract not between legal entities but between you: a man/woman, and i: a man; Eric Peiffer; sometimes acting as manager of Globalsilver. I: a man; Eric Peiffer; like to address potentially sensitive issues up front rather than sweep them under the carpet, and i: recommend that you: read this paragraph carefully. I: make it a habit to treat others as i: would like to be treated; i: treat other men’s and women’s property with great respect, and i: believe that relationship between you: and i: will be healthy and mutually beneficial if you: also respect property of i:, the outline of which i: provide below. The wording of this section is unusual and a little cumbersome. Nevertheless, it makes sense and is necessary. Here it is considered that any order placed by legal person of you: a man / woman is placed by you: a man / woman moving it.


You: a man/woman and not a legal person, are free to use as you: see fit any information that you: have not obtained, directly or indirectly, through one of the third parties with whom Globalsilver put you: in contact, and which relates to the manner of transporting or having goods transported between France and another country of the European Union.


However, i: a man; Eric Peiffer; do not want you: a man/woman, to induce, either directly or indirectly, the partner from whom order of you: can be collected to give you: any information that could be considered as allowing or having allowed, either directly or indirectly, ensuring or helping to organise the shipment outside France or the transport outside France of order of you:, any subsequent order of you:, or one or more orders from third parties, because then it would not be VAT at 0% that would be due, but the full VAT rate of country of residence of you: or the countries of residence of the third parties concerned by actions of you, which would be much higher than the commercial margin of Globalsilver. I: a man; Eric Peiffer; say that if such a thing happens as a result of words or acts of you:, then it will be fair that you:, and you: alone, bear the consequences. In the following, i: define what is trespass, and i: specify the amount of compensation that i: a man; Eric Peiffer; will ask you: a man/woman to pay, in the event that you: do trespass on property of i:.


If you: a man/woman, collect order of you: yourself from a partner of Globalsilver, you: agree:


  1. to refrain from asking any of the employees or representatives of Globalsilver’s partner to ship your order outside of France,
  2. and not to ask any of the employees or representatives of Globalsilver’s partner any questions about how any goods could be transported from France to another country in the European Union,
  3. and to ensure that any man/woman accompanying you: complies with these same terms,
  4. and to be responsible for any failure to comply with these same terms by any man/woman accompanying you:.


If you: designate a third party to collect your order from a partner of Globalsilver, you: agree:


  1. that he or she will refrain from asking any of the employees or representatives of Globalsilver’s partner to ship order of you: outside of France,
  2. and that they, whether male or female, will not ask any of the employees or representatives of Globalsilver’s partner any questions about how any goods could be transported from France to another country in the European Union,
  3. and to be responsible for any failure by that man/woman to comply with these terms,
  4. and to ensure that any man/woman accompanying him/her complies with these same terms, and to be responsible for any failure to comply with them by any man/woman accompanying the man/woman you: have designated to collect order of you:.


Furthermore, in the event that the partner from whom order of you: can be collected, one of their employees or one of their representatives, gives you: a man/woman, or a man/woman designated by you: to collect order of you:, or a man/ accompanying them, any information that could be considered to enable or assist in organising, either directly or indirectly, the shipment or transport of goods between two countries of the European Union, or as having enabled, either directly or indirectly, such shipment or transport to be carried out, you: undertake to keep this information confidential and to never make use of it.


I, Eric Peiffer, a man, declare that failure to comply with this undertaking could cause harm to Globalsiver and could therefore cause harm to i: a man, at times acting as manager of Globalsilver. I: state that any harm caused to i: would constitute trespass by means of theft, and i: state that you: a man/woman, who committed trespass, will immediately become liable for the following compensation:


  1. the full VAT rate of country of residence of you: on the total amount of each of concerned orders of you:,
  2. and, for each of the third-party orders affected by failure of you: to fulfil commitment of you:, the full VAT rate of the third party's country of residence on the total amount of their order,
  3. and any penalties or fines that may be imposed on Globalsilver,
  4. and all of Globalsilver's representation costs and travel expenses for at least one of its representatives,
  5. and €1 per minute for as long as the trespass or at least one of its consequences persists.


I: a man; Eric Peiffer; say that any trespass will be examined by a court composed of men and women, not legal entities, which will convene at request of i:.


I: a man; Eric Peiffer; recommend that you: only place a purchase offer with Globalsilver if you: honour commitments of you: and are responsible for words and actions of you:.



WE CHARGE VAT AT THE APPLICABLE LEGAL RATE, WHICH IS ZERO


We charge VAT at the applicable rate, i.e. French VAT at 0%, and send you an invoice by email stating this. For each of the silver coins we sell, the price displayed is therefore a price that includes VAT, a price that is equal to the price excluding tax.


You will not have to pay VAT when crossing borders, as long as you remain within the European Union and provided that you comply with any applicable reporting obligations that you are responsible for fulfilling.



WE OFFER COLLECTION FROM OUR CENTRE OR SHIPPING WITHIN FRANCE


The following options are available to you when you confirm your purchase offer:

  1. Collect your order yourself from an eligible collection centre in France (the list of centres is shown below),
  2. Designate a third party (individual or professional) to collect it on your behalf from an eligible collection centre (the list of centres is displayed below),
  3. Ask us to deliver your order to the address of your choice in mainland France (excluding Corsica and PO boxes).


All orders we ship are entrusted to UPS and are insured for their purchase value. We do not ship abroad.


Whichever option you choose, we charge shipping and insurance costs to the delivery address or collection centre.


Whichever option you choose, you agree that, for parcel insurance purposes, we may need to divide the contents of full boxes of 500 or 250 silver coins into several parcels. In all cases, you will receive the original containers (plastic tubes and boxes) in which your order would have been placed if it had not been shipped.

If you choose to collect your order from a collection centre, there are two options:


  1. either you adapt to our operations and agree to collect your order from the collection centre before the end of the fourth working day following the day on which it arrives there, based on the tracking information provided by UPS, which you will have access to as soon as your order is dispatched.
  2. or you ask us to adapt to you by making arrangements for your order to be available at the collection centre of your choice on the date of your choice, for a maximum of four working days. In this case, we will ship your order on the previous working day using UPS Express Saver. Although this service comes with a delivery guarantee, unforeseen circumstances may arise and delay the availability of your order. It is your responsibility to check the tracking information regularly and adjust the time of your departure to the collection centre accordingly. In the event of a delay in your order, we will not be liable for any compensation or penalty of any kind. You also agree to collect your order from the collection centre before the end of the fourth working day following the day on which it arrives, based on the tracking information provided by UPS, which you will have access to as soon as your order has been dispatched.


In both cases of collection from a collection centre, we may send you reminder emails. The collection deadline stated in these emails may differ from that given by UPS or deduced from UPS tracking information (this collection deadline is the fourth working day after your order arrives at the collection centre). In all cases, the date given by UPS or deduced from its tracking information is the only one that is valid, which you accept.


If your order is not collected before the end of the specified period, we will immediately arrange for it to be transported by Loomis to the nearest Loomis centre to the collection centre, where it will be stored for up to 60 calendar days. The costs of transport and storage, including insurance, will be entirely at your expense and must be paid to us by bank transfer within 48 hours of us sending you a payment request by email. We will apply a 30% commercial margin to the price charged to us by Loomis for return transport. Storage costs will be charged at 1% including VAT of the amount of your order for up to 60 calendar days of storage, without any pro rata refund for any reason whatsoever. Before the expiry of this 60-day period, you may arrange with us by email for your order to be re-shipped. We will charge you the UPS shipping costs plus 30%, as well as 0.60% for insurance, and will ship your order after receiving your payment. In the event of non-delivery or non-collection from the centre within the same period of 4 working days from the date of arrival at the centre, a period which you are responsible for complying with, we will resell all the coins in your order to a buyer of our choice, pay them the price agreed between them and us, and will refund you this price, less the aforementioned costs and a €500 administration fee, upon receipt of your bank details, thereby cancelling your order, without any compensation or indemnity being due to you for any reason whatsoever.


If you designate a third party to collect your order, any change in their first name or surname will result in your order being returned and a new shipment being sent, which we will charge you for at twice the price of the first shipment plus a £150 administration fee.



Delivery to the address of your choice


We work exclusively with UPS. We do not accept delivery addresses in Corsica or PO boxes. If you provide a delivery address in Corsica or a PO box, we shall be free to cancel your order, even after accepting your purchase order, without owing you any penalty or compensation of any kind. We will refund any transfer received from you as soon as possible after receiving your bank details.


If the recipient is absent during the first delivery attempt, according to UPS information, a second attempt will be made. On the day of the first delivery attempt, the recipient can schedule this second attempt on the UPS website for a date of their choice within a maximum of 4 working days. If the recipient is absent on the second delivery attempt, according to UPS information, your order will be returned and we will charge you the following price for a second shipment: twice the price of the first shipment as well as a service fee of €150.


All our shipments are insured for the amount of the order. However, we do not guarantee damage resulting from:


  1. foreign or civil war
  2. confiscation, expropriation, nationalisation or requisition
  3. the intentional fault of the purchaser
  4. the direct or indirect effects of explosions, heat release, radiation from atomic transmutation or radioactivity, as well as damage due to the effects of radiation caused by the artificial acceleration of particles
  5. earthquakes, volcanic eruptions, tidal waves and other natural disasters
  6. land subsidence or landslides causing damage within a radius of 30 metres around the location of the insured property
  7. flooding, backflow and overflow caused by seawater or water from natural or artificial watercourses or bodies of water
  8. theft committed by members of the purchaser's family, as referred to in Article 380 of the Criminal Code, or with their complicity.



WE RECORD PURCHASE OFFERS AND ARE FREE TO REFUSE YOURS


When you confirm your order, you are placing a purchase offer and committing to pay the total amount by bank transfer. We will send you an email detailing your purchase offer, in particular the unit price of each of the silver coins included in the offer and the bank details of the French account to which we ask you to send your transfer. The sending of this email does not constitute acceptance of your purchase offer.


It is only upon receipt of your transfer that we will know whether, particularly given the fluctuation in the price of silver, we have an economic interest in accepting your purchase offer. When we confirm receipt of your transfer, we will notify you by email and let you know whether we accept your purchase offer or not. The contract is concluded if and only if we accept your purchase offer. We believe that you will maximise your chances of having your purchase offer accepted by sending us your bank transfer immediately.


If we accept your purchase offer, we make an irrevocable commitment, based on the choice you make when confirming your order, to ship it to the address of your choice in mainland France (excluding Corsica and PO boxes), or to one of the eligible collection centres where the recipient (who may be yourself) that you have designated when confirming your purchase offer can collect it. A purchase offer becomes an order if we notify you that we accept it.


If we refuse your purchase offer, we will refund you by bank transfer, without delay upon receipt of your bank details, unless you decide to confirm a new purchase offer within 60 minutes of our refusal, in which case we will allocate the amount of your transfer to the payment of the new offer, leaving you to deduct the amount already paid for your refused purchase offer from the total amount due for your new purchase offer. If the amount of your purchase offer is less than that of the rejected purchase offer, we will refund the difference upon receipt of your bank details. If your purchase offer is rejected, we will not owe you any penalty or compensation of any kind.


However, you are bound by your purchase offer once it has been validated, which requires you to transfer the amount of your purchase offer to us within the time frame specified in the "payment" section of these terms and conditions.



WE REQUIRE PAYMENT BY BANK TRANSFER


All purchase offers must be paid for in advance by bank transfer, so that Globalsilver's account is credited no later than the end of the fourth working day following the day on which your purchase offer was confirmed. We recommend that you send us your transfer immediately after placing your purchase offer. If we do not receive your transfer within this period, we will be free to cancel your purchase offer without any compensation of any kind being due to you.


If we have not received your full payment seven calendar days after placing your purchase offer, you will be in default of payment. In such a case, we will no longer accept any further purchase offers from you: unless we notify you otherwise by email, any further purchase offers you validate will be automatically cancelled and we will not be obliged to inform you in any way. Nevertheless, we will refund any amount received by bank transfer.



WE CHARGE FEES FOR ATYPICAL ORDERS


An atypical order is an order that does not consist solely of complete tubes and boxes. An atypical order is therefore an order for which we need to place some silver coins in individual zip bags.


We charge a fixed fee of €10 including VAT per atypical order. You can avoid this fee by modifying your order so that it consists only of complete tubes and boxes.



WE TRANSFER THE RISKS AT A SPECIFIC TIME


The market risk, i.e. the risk of adverse price fluctuations of the silver coins in your order, is entirely yours in all circumstances.


If you request to collect your order yourself from a collection centre, the transfer of risk of loss or damage occurs when you sign the delivery note for your order.


If you request that your order be collected from a collection centre by a designated third party who is a private individual, then the transfer of risk of loss or damage occurs when that designated third party signs the delivery note for your order.


If you request that your order be collected from a collection centre by a designated third party who is a legal entity, then the transfer of risk of loss or damage occurs when the delivery note for your order is signed by anyone who presents themselves at the collection centre acting on behalf of or for the account of that legal entity.


If you request that your order be delivered to an address of your choice in mainland France (excluding Corsica and PO boxes), then the transfer of risk of loss or damage occurs when your order is delivered to you or to an adult at the delivery address, unless you request a change of delivery address or delivery to a UPS collection point ("UPS access point") while your order is in transit within the UPS network, in which case the transfer of risk takes place immediately, meaning that our liability ends at the time you make your request. It is your responsibility to check or have the adult receiving the delivery check, in the presence of the delivery person, that your order is complete and that no silver coin composing it has been damaged, and, in the event of a problem with the delivery, to specify or have the adult receiving the delivery specify the nature of the problem, including the number of missing or damaged silver coins and their names, on a document that will be dated and signed by you or by the adult whose first and last names will be mentioned, and countersigned by the delivery person whose first and last names will also be mentioned. Any complaints regarding delivery must be sent to us by registered email to customercare@vat-free-silver-coins.fr before the end of the working day on which the delivery is said to have taken place, as evidenced by UPS tracking information. Any complaints made after this deadline or in a non-contractual manner will not be accepted.



OUR OPERATIONS INCLUDE DELIVERY TIMES


Our website displays a date on which we believe your order will be available (theoretical availability date), defined as the date on which we believe all the silver coins in your order will be available for shipment to the collection centre or delivery address of your choice. This date is expressed in number of working days, counted not from the acceptation of your purchase offer but from the confirmation of receipt of your transfer. This date is indicative, and the actual availability date of your order may differ depending on market conditions. We are committed to shipping your order as quickly as possible and have a genuine interest in doing so, as we store and insure it free of charge until its actual availability date, which means that the sooner the actual availability date arrives, the higher our margin.


To clarify, we will be required to refund the amount you have paid us only if we ship your order more than 29 calendar days after the availability date indicated when your order was confirmed, unless an exceptional delay has been mentioned on the web page of at least one of the silver coins in your order, in which case the 29 days will begin to run after the expiry of that delay.


However, in all cases, if the delay is the result of an event beyond our control, if we inform you of this and if we do everything we can to reduce it, then we will not be obliged to cancel your order free of charge or to pay you compensation. If the delay is longer than you can accept, you may contact us by email at customercare@vat-free-silver-coins.fr and ask us to terminate the contract and refund the amount you have paid us, less any reasonable costs already incurred by Globalsilver.



WE DO NOT OFFER A RIGHT OF WITHDRAWAL


Our entire catalogue is excluded from the scope of the legal right of withdrawal (Article L. 121-20-2 of the Consumer Code).



WE DO NOT ACCEPT RETURNS


Returns are not accepted.



WE DO NOT PROVIDE ADVICE


We believe, without being certain and without this opinion being binding, that there is no customs declaration to be completed when crossing the border with silver coins, even if their value exceeds €10,000. However, we do not provide legal advice, and although we believe they are unnecessary, we have always completed these declarations, which in France are called Dalia (cash declarations) and must be submitted on the customs website. It is your responsibility to find out about the applicable law and to take all appropriate steps to comply with it.



WE HAVE LIMITED LIABILITY


We can only be held liable for damages resulting from negligence on our part.


In any event, we cannot be held liable for any financial losses or any direct or indirect consequences thereof.


Our liability, if incurred, is always limited to the amount of the invoice. No incident shall give rise to the payment of damages by Globalsilver, in any form whatsoever.


In the event of force majeure, we may suspend our obligations without incurring any liability. Force majeure includes, but is not limited to: riots, sabotage, war, exceptional weather conditions, transport paralysis, and changes in the legislative framework that prevent us from fulfilling our commitments.



MARKET RISK


The value of the silver coins offered, insofar as it is influenced by fluctuations in the financial markets, is subject to change. You acknowledge that you have been advised of this, understand the risks inherent in investing in precious metals and accept them, without us being liable at any time for potential losses or their consequences, whatever they may be.



DISPUTES


The law applicable to the part of the contract concerning legal persons, namely all paragraphs of these general terms and conditions of sale except for the paragraph entitled “WE WORK WITH RESPONSIBLE MEN AND WOMEN”, is French law and French law alone. In the event of a dispute that cannot be resolved amicably, it shall be brought before the French court with jurisdiction closest to the registered office of Globalsilver.


Within the framework of the paragraph entitled "“WE WORK WITH RESPONSIBLE MEN AND WOMEN”, any harm caused to Eric Peiffer, a man, shall give rise to the convening of a court composed of men and women and not legal entities, at the request of Eric Peiffer.



ARCHIVING


Contracts concluded on our website (data relating to your order and the GTC in force on the day of your order) are archived for a period of 10 years. You can access archived contracts by sending a request by email to customercare@vat-free-silver-coins.fr.



FINAL NOTE


We agree in principle to sell the silver coins in our catalogue and ship them outside France within the European Union. However, for such orders, VAT at the full rate of the country of delivery must be added to the prices listed on our website, as well as the shipping and insurance costs that apply given the order and delivery address.
